An 18-Year-Old man from Bulawayo had S*X with a 25-Year-Old mentally challenged woman without her consent


AN 18-YEAR-OLD man from Burnside suburb in Bulawayo has been arraigned before the courts for allegedly raping a 25-year-old mentally challenged woman whom he was staying with.

The accused (name withheld) was not asked to plead when he briefly appeared before Bulawayo magistrate Mr Abedinico Ndebele for contravening section 65 of the Criminal Law (Codification and Reform) Act Chapter 9:23, rape.

It is the State's case as presented by Marlvin Nzombe that on 24 July this year at around 7pm, the complainant (name withheld) went to watch television in the accused's bedroom.

The court heard that while the complainant was busy watching TV, the accused allegedly removed her pants and undergarments before ordering her to lie on his bed. It is said after the complainant had slept on the bed, the accused person then undressed himself before he wore a condom and had s*xual intercourse with the mentally challenged woman.

The accused allegedly closed the complainant's mouth with his palm to stifle her screams.

After having s*x with the complainant, the accused allegedly ordered her to dress up.

The complainant later left the room and while outside she was spotted crying by her father who asked her what had happened before she told him that she had been s*xually abused by the accused person.

The father then instantly called other tenants at the house to listen and witness what the daughter was saying. One of the tenants, who is also a member of the Neighbourhood Watch Committee, later questioned the accused about the allegations levelled against him.

The court heard that at first, he denied but later admitted that he had s*xual intercourse with the complainant. The complainant's father and the tenants then went to the accused's bedroom where they saw a torn condom used by the accused.

A report was made to Hillside police leading to the arrest of the accused person.

He was remanded in custody to tomorrow (Monday)
